CORRIGENDUM No: 1 to the CONTRACT NOTICE AND INSTRUCTIONS TO TENDERERS - Tender Procedure - Publication Ref: CB006.1.21.104 -04/Works/PP2–(2)

Subject: Execution of works on the site “Architectural and construction restoration of the “St. Archangel Michail” church”, the town of Rila, funded under project No CB006.1.21.104.
Location: Municipality of Rila, Republic of Bulgaria
Based on the necessity of changing the procedure documents and according to the point 6 from Instructions to Tenderers, Municipality of Rila is modifying some aspects of the Tender dossier.
The CONTRACT NOTICE is corrected or modified as follow:

In order to be eligible for the award of the contract, tenderers must provide evidence that they meet the selection criteria. If a tender is submitted by a consortium, unless specified, the selection criteria will be applied to the consortium as a whole.

If a tender is submitted by a consortium, the tenderer must present in the offer a Contract/Agreement between the participants in the consortium for establishing the consortium. The Contract/Agreement for establishing the consortium must contain a detailed and clear distribution of the activities, performed between the participants in the Consortium.

14.b.5. The chosen for contractor must provide proves that it has professional qualifications as a construction entity. According to the Bulgarian Chamber of Builders Law entities executing construction in Bulgarian from 1st to 5th category as per the Bulgarian Territory Structure Act should be registered in the Central Register of Professional Builders. The registration is also obligatory for builders, which are entitled to perform such an activity under the legislation of a Member State of the Union or of another country - party to the Agreement on the European Economic Area or of the Swiss Confederation for registration.. The chosen contractor, before signing the contract must provide evidence that it is registered in the Bulgarian Chamber of Builders for the execution of construction of Ist category as per art. 137, par. 1, point 1, letter M as per the Bulgarian Territory Structure Act and in accordance to the Rules of Procedure for Recording and Keeping of the Central Register of Professional Builders. At the moment of provision of the tender offer, tenderers are not obliges to prove that they meet this requirement.

If a tender is submitted by a consortium, the Contract/Agreement for establishing the consortium must contain a detailed and clear distribution of the activities, performed between the participants in the Consortium, from which Contract/Agreement, the Contracting Authority unconditionally, will be able to assess, depending on the obligations imposed on them under the Contract/Agreement for establishing the Consortium, the need for registration by the Low of Bulgarian Construction Chamber of one, several and/or all the participants in the Consortium.

14.b.6. (1st paragraph)The chosen for contractor tenderer must provide proves that it has a valid professional risk indemnity insurance.
If the tenderer is registered in Bulgaria it must have a professional risk indemnity insurance in accordance with art. 171 of the Territory Structure Act in Bulgaria. The minimum coverage of the insurance should be in compliance with the Ordinance for the conditions of compulsory insurance in design and construction in Bulgaria (SG. No. 17/02.03.2004) for objects of Art. 137, para. 1, item 1, letter “M” of the Territory Structure Act of Bulgaria.

All other terms and conditions of the tender documentation remained unchanged. The above changes and / or corrections to the tender documents are an integral part of the tender documentation.

The modifications are not essential and the deadline for tenders’ submission will not be prolonged
